1. Acceptance of Terms
By checking the relevant box during the registration or subscription process the customer agrees to be bound by these Terms and Conditions. The use of the Hellocycle’s service constitutes the customer’s ongoing acceptance of these Terms and Conditions.
2. Use of Service
Hellocycle’s service is $15/month or $150/year. Customers will receive an empty box suitable for 2 CFL’s, 8-10 batteries and various other small electronic items, thermostats and CD’s as pictured, within approximately two weeks of their order if not sooner. Customers may fill, seal, and return this box as frequently as they like. Upon receipt of their box, we will open, process and record, and recycle the supplied items, and send them a new empty box. Customers may send in their box as frequently as they like, allowing 1-2 weeks for shipping each direction.
Customers are not permitted to use the Hellocycle’s service for any purpose that is unlawful or is prohibited by these Terms and Conditions.
3. Billing and Payment
The original name of the company was Buttercup Zero Waste Engineering. That was hard to say, so we changed it to Hellocycle, Inc. as a dba (“doing business as”) name. That is why your credit card statement will say Buttercup Z dba Hellocycle.
All transactions are in USD. All fees are non-refundable and are required to be paid before any service is rendered.
Hellocycle reserves the right to cancel any account or any service within an account if payment is not received on time.
4. Disclaimer
The customers agree to use all the services of Hellocycle at their own risk.
Hellocycle makes no warranty that it’s services will meet the customer’s requirements, that the service will not be interrupted or be error free.
No advice or information, either written or oral, obtained by the customers from Hellocycle shall create any warranty.
5. Indemnification
The customer agrees to indemnify and hold harmless Hellocycle from all claims, damages, losses, liabilities and expenses filed by a third party against Hellocycle arising out of the customer’s use of the Hellocycle’s services. The terms of this section shall survive the termination of the customer’s account or use of the services.
6. Limitation of Liability
The customers agree that Hellocycle shall not, under any circumstances, be held responsible for the illegal or illicit access by third parties to customer’s data via the Hellocycle’s service, however arising.
In no event shall Hellocycle be liable for any indirect, punitive, consequential or any other damages whatsoever for loss of use, loss of data or loss of profit arising out of disruption to it’s service, mistakes or omissions in the service, deletion of files, loss of data, viruses or any other failure in the performance of the service whatsoever.
7. Copyright
All the content of the Hellocycle website and other materials forming the service are owned and the copyright of Hellocycle or it’s suppliers. All rights reserved. Reproduction or distribution of the Hellocycle Website’s content is prohibited without the written permission of Hellocycle.
Customer shall ensure that material on their account does not infringe the copyright of third parties. If Hellocycle believe that a customer’s account may infringe a third party’s copyright such account shall be disabled.
8. Modification of Service
Hellocycle reserves the right, at any time and at its sole discretion, to modify or discontinue any part or all of it’s services, with or without notice.
Hellocycle reserves the right to delete or modify any part of a customer’s account, with or without notice to the customer.
9. Termination of Customer’s Account
Termination by Customer:
A customer may terminate their subscriptions or account at any time, however Hellocycle will not refund any fees upon such termination.
Termination by Hellocycle:
Hellocycle may at it’s sole discretion terminate a customer’s account for any reason and at any time and without notice to the customer. If the customer has breached these Terms and Conditions Hellocycle shall not be required to refund any fees to the customer.
Deletion of Content Data:
Hellocycle reserves the right to delete the customer’s account content data upon termination of the customer’s account. The customer can not make any claim to the ownership of such data.
10. Privacy Policy
The use of the Hellocycle Website and it’s services constitutes the customer’s ongoing acceptance of these Privacy Policy.
